VLUGER

Terms and conditions of online services

Working draft — 18 October 2026

Draft pending Belgian legal review and technical verification before final publication.

1. Parties and application

These terms govern services supplied by VLUGER, a trade name of TSH INVEST SRL, Place Madou 7, 1210 Brussels, Belgium, company number 0506.845.487, VAT BE 0506.845.487, contact@vluger.com. They apply to business customers and consumers; mandatory law prevails.

2. Services and orders

VLUGER creates, sells and rents websites and offers hosting, maintenance and optional services. The order specifies scope, price, duration and inclusions. Where payment is required, production begins after confirmed payment. Unpaid orders do not enter production.

3. Prices and payments

Business prices may be shown excluding VAT. Consumers must see the full VAT-inclusive price, mandatory charges, payment frequency and subscription terms before ordering. Stripe may process payments; Odoo may manage invoices.

4. Project brief and client duties

Clients must submit a usable Project Brief and necessary content, and warrant that they hold appropriate rights. Missing information, unclear instructions and pending approvals may suspend relevant timelines. Versions of the Project Brief may be retained.

5. Indicative delivery targets

Operational targets include 24 business hours for reviewing a submitted Project Brief, 72 business hours for a first draft after approval, 24 business hours to acknowledge correction requests, 48 business hours for correction rounds 1 and 2, and 72 business hours for round 3. These are indicative targets, not absolute guarantees, unless a firm deadline is expressly agreed. They depend on client cooperation and normal technical conditions. Saturdays, Sundays and Belgian public holidays are excluded. A reasonable occasional overrun does not automatically trigger compensation; statutory remedies for significant delay or non-performance remain intact. Marketing must not promise an unconditional guaranteed deadline.

6. Corrections and delivery

Standard services include up to three correction rounds within the agreed scope. Requests for clarification do not consume a round. After round 3, the latest version may be delivered, subject to contractual conformity and mandatory rights. Options have separate delivery statuses and do not prevent completion of a conforming main website. Later options are separate interventions.

7. Website purchase

Purchasers receive the deliverables and usage rights specified in their offer. Copyright transfers require precise agreement. Third-party software, fonts, images and other components remain subject to their licences. Hosting and maintenance are included only where expressly stated.

8. Website rental

Rental grants use of the website during the subscription; it does not automatically transfer proprietary source files or code. Any buyout follows the terms disclosed before purchase. Exceptional file handover on permanent closure is covered below.

9. Hosting, maintenance and subscriptions

Recurring services cover only the agreed scope. Additional development or redesign may be quoted separately. Renewal, termination and effective dates must be disclosed before subscription. Clients may request cancellation in their account or by email, without prejudice to mandatory consumer rights.

10. Consumer withdrawal

For distance service contracts, consumers generally have 14 calendar days from contract conclusion to withdraw, subject to statutory exceptions. Payment alone does not remove this right. Where the consumer expressly requests performance during the withdrawal period, a proportionate amount for services actually supplied may be payable on withdrawal if legal information and consent requirements are met. The right may be lost after full performance only where all statutory conditions, including prior express consent and acknowledgement, are satisfied. Digital content and digital services may be governed by different rules. Hosting and maintenance subscriptions are not fully performed merely because a website draft is delivered. Withdrawal may be communicated to contact@vluger.com or using the withdrawal form; statutory refund deadlines apply.

11. Business customers

Business customers generally have no statutory 14-day withdrawal right for online service contracts, unless a specific mandatory rule or express agreement provides otherwise.

12. Non-payment and suspension

VLUGER may seek payment and take contractually and legally permitted action. Consumer reminders, charges, interest and suspension must comply with mandatory Belgian law.

13. Permanent closure and file handover

If VLUGER permanently ceases trading, is dissolved or liquidated, or becomes durably unable to continue its services, it will, to the extent legally and practically possible, make available existing website files for purchased and rented websites. Files will reflect the latest usable available version. Non-transferable third-party licences, trade secrets, third-party data and materials VLUGER cannot legally transfer are excluded. For rented websites, VLUGER grants a non-exclusive, royalty-free licence to use the VLUGER-owned elements actually delivered, to the extent of its rights. Clients will have 60 calendar days from effective notification that files are genuinely available to download them. Notice will be sent to the last known email address and, if possible, the client account. After that period, copies may be deleted, subject to statutory retention and mandatory rights; the deadline cannot prejudice a client prevented from downloading by a failure attributable to VLUGER. If closure objectively prevents hosting or maintenance, services may stop at short notice where unavoidable. VLUGER will notify clients as reasonably possible and assist migration within its means. Prepaid unperformed services will be adjusted or refunded as legally required. This provision does not waive non-excludable liability and is subject to insolvency law.

14. Liability and force majeure

VLUGER remains responsible for its contractual obligations under applicable law. Events outside its control may affect delivery under legal rules. No provision removes mandatory consumer remedies or excludes liability where unlawful.

15. Personal data

Our Privacy Policy describes processing. A data processing agreement will be concluded where required.

16. Complaints and law

Complaints: contact@vluger.com. Belgian law applies, without prejudice to mandatory consumer protections and the courts legally competent to hear disputes.

17. Contract version

The version accepted at checkout must be preserved and communicated on a durable medium. Later changes do not retroactively amend a contract without a valid legal basis or agreement.
